An experienced FBI intelligence specialist has brought a lawsuit claiming his dismissed because of exhibiting a rainbow symbol at his workstation.

As per David Maltinsky, that was employed for the FBI for 16 years, the firing in the past months was “illegal and discriminatory”.

Legal Proceedings Alleges Free Speech Breaches

The legal filing states that the FBI violated the employee’s First Amendment rights and engaged in retaliatory action in his case for expressing legally safeguarded communication.

The former specialist is asking for a judicial directive to reinstate his employment with the FBI.

Particulars of the Complaint

The comprehensive complaint, submitted in federal court for the District of Columbia, alleges that the plaintiff was fired from the FBI academy last month because of earlier exhibiting the Pride symbol on his desk.

Per the document, the rainbow symbol was presented to the employee to honor his work to advance the agency’s equality efforts.

Early on, my only desire was to serve the United States and ensure its security together with the talented and committed individuals of the FBI,” remarked the former employee.

He continued, “I displayed that symbol – which once was raised before the Los Angeles office – not as a political statement, but rather as an emblem of diversity, togetherness and fair treatment.

“These are the values that previously strengthened the bureau effective. Now it is a place where people like me are targeted. I think I was terminated not on account of who I am, but rather because of what I represent: a homosexual man,” he said.

Sudden Dismissal Before Completion

Earlier this year, Maltinsky gained admission to the bureau’s agent course in Virginia, until what he described as “sudden termination only weeks prior to completion”.

The lawsuit additionally states that later after the presidential inauguration, another employee reported a complaint to the overseeing official concerning the exhibition of the rainbow banner.

As a precaution, the plaintiff requested that the Chief Division Counsel for the Los Angeles field office examine whether or not the display of the LGBTQ+ banner was permissible,” the document stated.

The document continued, The legal officer informed the plaintiff that the display of the flag complied with any bureau guidelines.”

Notification of Dismissal

Despite this, on 1 October, Maltinsky was informed of his dismissal.

In correspondence referenced in the lawsuit, bureau chief Kash Patel commented, I decided that you used bad decision-making by exhibiting of a partisan emblem in your office during your previous assignment at the Los Angeles Field Office.

Under Article II of the United States Constitution, and regulations of the nation, your job with the FBI is concluded.”

Legal Remarks

In a statement issued on Wednesday, his attorney Kerrie Riggs stated, The current leadership’s unlawfully firing him is a component of a broader effort to rid federal agencies of workers who may have different viewpoints, or represent marginalized groups, or those who challenge bias.

This battle is not only for him, but also about ensuring the entitlements and freedoms of all public servants.”

Department Reaction

The bureau declined to comment about the legal action.

This legal action comes after another one submitted earlier by previous senior FBI officials that claimed they were unlawfully fired.

They stated that the director claimed he was ordered by the White House to dismiss any agent associated with a probe into Trump.

Additionally, the FBI fired an experienced official earlier this month subsequent to the official was said to be angered by reports that the bureau chief used a government jet to attend a match at which his companion performed the anthem.

The official, an FBI employee for over two decades, was dismissed from leading the bureau’s emergency unit, which manages significant risks and the agency’s jet fleet.
